Dear Seniors,
Please let me know that can PL/CL/SL leaves be credited to such employee who completes any year of his/her service in the company during his/her notice period ??? In our office, one employee has served notice & as per the notice he will work till 20th October 2013 & on 17th October 2013 he completing two years of his service in our company.

Dear Gajinder Singh,
Notice period is just a period to provide the company to make his replacement and vice-versa. Employees is working as usual and as such he is entitled to all benefits accruing to him till his last working day.
If we deprive the employee benefits for the notice period, then notice period will look like punishing period?
In fact, we grant leave also during notice period and notice period is extended for days of leave.

Dear Gajinder,
This is very much dependent on the leave policy of the company. The organization in which I work, we give PL credit to the employees serving the notice period.
Since the employee has already completed two years in your organization I see no harm in giving him the leave credits. He deserves to get it.

The Leave policy should be as per calendar year, so once the employee has completed his/her probation is entitled for all the leaves on pro rata basis till his last working day. e.g. if the employee's last working day is last day of the month then he/she is entitled for leave of the said month also.

Since the PL leave is credited on the basis of the working days, the total working days including notice pay period is to be considered for that purpose.

Dear Gajinder,

The employee who is on notice period shall be considered as an employee till his Date of Leaving (last day of service). Hence, the PL computation has to be made till his last day of service. As rightly pointed out by a member the notice period is to give the employer time to find a replacement and for the employee to hand over responsibilities to the new employee who has been identified by the employer from the employee who will quit.

In fact even annual benefits such as LTA, Medical reimbursements etc shall be paid proportionately till his Date of Leaving the company.

As regards leave availed during notice period some companies extend notice period for the period of leave availed and some other companies adjust leave available to the credit of the employee. Some companies practice granting leave on Loss of pay during notice period, though leave is available to the credit of the employee. On the other hand, they pay up for the unavailed leave, as well they can adjust this against the leave availed by the employee during notice period and make it simple,
