Hi All,
I was working with one 5 year old start up company since 2010, resigned last month because of following listed issues.
We used to get regular salaries on time. Suddenly delay in salary started from Aug. 2012.
We had came to know that, company is facing financial crisis hence salary delay will happen for next few month. We received Nov. 2012 salary in Jan. 2013. Only part payment received of Dec. 2012 salary in 2-3 chunks, that too in April and June 2013.
Seeking guidance for the following problem.
Company has not paid salary since Dec. 2012
Company has deducted PT and IT from salaries but not remitted to Govt. yet.
Most of employee resigned in Aug. 2013, Company has mention in relieving letter that they haven't paid salary from Dec. 2012 to March 2013.
Company has not issued Form 16 to any employee.
Please guide me how to get our pending salaries and form 16 from the company.

Given the condition of the company, you are unlikely to get your money.
However, you can do the following :
Complain to the labour commissioner about unpaid salaries, specially since you have it stated in the relieving letter.
Complain to the income tax office about non remittance of tds. You can go and meet the PRO at aikar bhavan (I think it's at koramangala) and speak to him. He will either tell you how to complain or take you to the assessment officer handling that company.
You can complain to the profession tax department.
I think that comes under commercial tax in Karnataka.
Information on that should be available on the Karnataka government website.
