Dear seniors,
Now am working in Tamilnadu it is an garment manufacturing unit now we planing to start an sub unit that is embroidery division. There are only 5 employees working now. My doubt is do i want to register with IF, ESI & PF. because i know a factory having more then 10 or 20 employees are applicable for both IF, ESI & PF..
Now what i have to do..?
There is any law will affect the running of the factory..?
Else need suggestion to do better legally..

1. PF act is applicable if having employees 20 or more
2. ESIC applicable to Factory on 10 employees ( covarable i.e less than 15000/- per month rate)

My answer to your query is as under. You need to choose right one amongst mine Vs. others.
As regards to PF: Applicable when you have 20 and more employees (head counts) including of contractors in your all units / branches / depts.
As regards to ESIS: Applicable when you have 10 and more employees (head counts) including of contractors in your all units / branches / depts.

Pf limit of 20 employees includes contractors employee ? I was not aware of that. I think the definition of employee does not include contracts employees.

Dear Saswata ji,
You are requested to read the definition of employee under section 2(f) which is given as under verbatim:
"employee" means any person who is employed for wages in any kind of work, manual or otherwise, in or in connection with the work of an establishment, and who gets his wages directly or indirectly from the employer, and includes any person-
(i) employed by or through a contractor in or in connection with the work of the establishment;
(ii) engaged as an apprentice, not being an apprentice engaged under Apprentices Act 1961 or under the Standing Orders of the establishment.

Dear sir,
Thank you for your involvement. We have a unit with 100 employees and now we are planning to start new unit with 5 employees. so here do i want to register with esi or pf for 5 employees(Because already we have 100 employees in main unit). here my doubt is the calculation of heads is what? is it including the main unit..? if is it there is no doubt i should register with both. this is what am asking sir.

I am not sure about esic, but pf is definitely applicable as the total number of employees are counted for the company as a whole. If you had given this information at the start, it would have saved a lot of people their time and efforts answering a point that was not there
