Dear All,
This is the first time that I have got the chance to release someone's gratuity. Since I have no experience in this field, hence I seek your help.
One of my colleagues had joined this company in May, 2008. He has resigned from his post. His notice period has a shortfall of 5 days which is till 1st October, 2013. His last drawn gross monthly salary would be INR 57820/- (which include Basic of INR 20410/- and other allowances as per his salary structure).
Please let me know what should be his Amount of Gratuity and what is the process of applying for/getting the Gratuity Amount.
Thanks in Advance,
Sonali

Dear Sir,
I have mentioned everything in detail in my post including the separating person's date of joining. He has completed 5 years 4 Months of continual service in our Company.
Secondly, I am not the one who is leaving the Company. It's my colleague. I have the responsibility to settle all his dues.

dear
Calculation: W x Y x 15/26 where W = Last Wage drawn i.e., basic + DA
Y = number of completed years of continuous service (six months or less to be ignored and more than six months to be counted as full year.
15 = 15 days salary
26 = No. of working days in a month.
* salary drawn (last basic+da)* 15/26* no of service years
ur ans gratuity calc=20410*15/26*5 = 58875/-.

Mr. Sood,
Is Gratuity Insurance Policy mandatory? We have only Mediclaim Policy and PF for employees. We don't have any gratuity insurance policy. The amount of gratuity is mentioned in the Salary Structure (for the entire Year) / Annual CTC of every employee. Those who has worked for less than 5 years (continuously) forfeit the gratuity amount. We don't have Dearness Allowance in our Monthly Salary Structure. Instead, apart from Basic Salary, we have HRA, Conveyance Allowance (fixed), Education Allowance (Fixed) and Personal Allowance (Fixed). Can these allowances take place of DA?

Dear Sonali, For the purpose of gratuity calculation, only Basic and Dearness Allowance(if part of the salary structure) should be considered.

Dear Divya, I thank you for the clarification. I would be glad if you can also throw some light on my doubts regarding Gratuity Insurance (please refer to my previous post).
