Hi
My company wants to terminate an employee but they don't wants to issue him a termination letter but wants him to give resignation and also wants to inform this to him in writing..
Kindly help me out if there is any letter format for the same or not

Dear Sarita,
You wanted to terminate an employee but then why? Is it on performance grounds or is it for "misconduct". In either case you need to conduct proper domestic enquiry. This will keep your position safe and strong forever. Nothing wrong in issuing termination letter but then if the employee submits resignation then regularise the termination into the resignation. While issuing employment certificate, you may not write the real cause of separation but write as "left on one's own accord".
If you visit the labour court, you will find that large number of labour cases arise because of improper handling of the process of discipline. Never ever leave any loophole in handling matters of employee discipline.

The reason of being termination is only the performance issues, he is not that much capable to meet the commitments what he did at the time of joining.
he has completed only 4 months with the company.

Saritha....is he still in his probation period. Is it 6 months or 3 months.
If such is the case I don't think u should have issue in terminating the employee..
Here...in my current company we have termination cause form, which is filles by the department manager and then accordingly we take the required action where we issue a letter along with 30 days notice period.
