I would like to get to know that, my factory is not covered ESI, bcz of it is situated in village area, If any women employee applied for Maternity leave, she can entitle the benefit of Maternity leave or not. Please give the confirmation.

Dear Sir
If your factories are not covered Under ESIC Then firs you can go with Comp.Polices or As Per Factory License act. Your co.Have Pay to 90 Days Paid Leave as per factory license act.

Advise : these two act are costlier than the ESI so you pull up some other companies in your area (stag employee population to establish a ESI dispensary) & Get covered under ESI by writing letter to Branch manager. not having ESI was going to be a costly affair to your & also other companies

Greetings of the day.

As regard to the ESIC and the Maternity leave /facilities... the best thing as per my experience are :

1. Mr. Ramnarayanhr... has advised the right thing... if that is possible, then pls try to take necessary action on that... u and ur employee will be benefitted by that..

2. I used to be the Factory HR/ a site where no ESIC hospital/dispensary facility could avail.. I used to give the company's contribution as Medical allowance to the workers every month..

3. As Ramnarayan suggested, I also tried to accumulate other factories nearby and pressurised the ESIC office to set up a dispensary there.... what they suggested that one can take the ESIC registration and worker can get treatment from Govt. Hospitals in their locality, and later can claim the treatment cost with proper supporting documents...

4. Maternity leave is compulsory as per the Govt. rules.. if u r hving women workers and they are in your pay roll then 90days with pay leave is what company has to provide. After that without pay..

When ESIAct is not applied to any area the female employees are entitled to maternity benefit under this act provided the female employee has worked for 80days in the factory/establishment.

Dear Mr. Manohar Gajare,
As per the Govt. rules the maternitiy leave is allowed with pay is 3 months which is equal to 90 days. One can avail 1.5 months before the deliverly and 1.5 months after delivery, and one can adjust as per her health condition.
Please do let me know as per Factory/shop & establishment act is it 80 days? .. Recently, Govt. has increased the Leave Limit to. Since you were holding a very Sr. position, would be thankful if you enlighten me.

AS per MB Act ,whether in the case of factory or commercial establishment, the leave with salary is for 12 weeks.6 weeks prenatal and 6 weeks post natal.In addition 30 days benefit is eligible for women suffering from sickness arising out of delivery.Govt rule is not applicable .If an employer give more leaves it is his policy.
