Leave with wages is payable in both cases
First 30.42 is only a numerical average of 30, 31 and 28 day months
Second, on 26 days working, the monthly salary in divided into 26 days, so in effect paying for the weekly off in working days

generaly for contract labour why should we pay Leave with wages 5% on Basic+DA?? Eplain.

Above All I agree with sri VNGuptaji expressed opinions. I try to add.
8hrs a day is prescribed to generally to a worker.
You said 3hrs a day in your company.
That means a part time job.
Neither totally come to contract labour or parttimelabour or regular.
Typically you have been under contract since a year.so we have nothing to say treat them as contract labour.
Generally leave with wages means for every worker works for 6days in a week or 48hrs in a week.the other day will be a holiday.That holidaybwage is already added in the payments made as per govt prescribed if you are paying now.
So you are paying leave with wages as per weekly holiday spread over point concern.
Now come to another leave with wages concern give as per agreement..or go liberal out look and pay I think 15days of medical usually per year to regular worker.
Another leave with wages.is payingwage on govt.fixed
NationalFestival.and other Holidays
Like October 2 nd independence day etc. ,8_holidays.per year.
You.should undoubtedly pay salary for thoseNFOHdays pls .So leave with wages have different meanings.
1.Wages paying on worked 6days in a week.payment of wage on weekly off that is already included in the Minimum wage fixed by Govt.
2.Another leave with wages mean payment of wages onGovt.declared holidays 08of NationalFestivalHolidays under NFOH ACT.
3.REGULAR EMPLOYEES ARE ALLOWED 15DAYS OF LEAVE WITH WAGES GENERALLY ON MEDICAL GROUNDS.THIS IS ALSO APPLICABLE TO ANY CONTRACT LABOUR..SIR.

I am working as contract employee through Teamlease company assigned to one MNC company when i checked with Teamlease company about leave policy they told me that working for MNC company leaves not applicable and told me to contact directly with client company HR when I checked with client HR. They told me leaves to contract employees is at the discretion of the Manager.
Is it true?.
But earlier I worked with the same company i.e. Teamlease client Dell emc that time they gave leaves monthly 1.25?
why leaves differs client to client?. I am not going to argue with client because if I argue they may take any action becasue for me job is most important than leaves until i get another job. Please suggest me if there is any law.

Dear Colleague,

The Leave Provisions are applicable to you as per Factories Act 1948 if you are posted in a Factory and as per Shops and Establishment Act if you are posed in a Shop/Establishment. The place of your posting is more important in determining the number of /types of your leave eligibility. What ever MNC you work with if they operate in India the Laws of India has to be followed. In some cases, the leave rules applicable for your Parent Company is followed as per service rules if agreed so for commonly adopting it for all employees of the Contract Company). Definitely it is not discretion but it is legal. Handle this very cool as you mentioned your job will be under threat and be tactful in this case. This is the poor state of situation we all work and it is reality too. Be aware that you are at the mercy of some one but you are legally entitled to leaves for this moment. How to get is all depends on the way forward you decide and when you get next offer check the leave privileges clearly documented before accepting the offer so that you are safe.
