Hi,

help needed !!

I have 3+ total experience in IT field. but because of some reasons i had to leave my current job because of some emergency. i informed my manager that i can not come for one month, but he said either report or we will terminate you. i asked for LWP but they did't provide. so i resigned and asked for settlement that i cant serve notice period, but they rejected my resignation and terminated me. After that they send me mail for no dues clearance (some amount they asked). I paid that and i asked about experience letter and revealing letter. they said you will get the appropriate letter. now i got job in other company so my question is this what will i say to that company at joining time. i m not sure what letter the previous employer will give now.

Till now they did't provide any thing but they are saying that they will give. I am regularly in touch with my manager, but in doubt if i will join company and later on if they fail to provide or they provided some other letter.

my another question is if they send termination letter than other company for which i am selected, will they accept me.

Please any body suggest me what to do.

You don't had enough leaves to compensate your emergency ?? Secondly were all your communication in verbal or in written ??
What was the reason mentioned in your Letter of resignation, whether your resignation was rejected in written and what was the reason mentioned for such rejection. Last but not the least what is your termination letter states. If you have accepted the termination with the reason mentioned thereof, there is hardly any chance to fight for.
But please let the forum know the entire thing to advice you accordingly

Thanks for reply.

Actually due to emergency i went to home. I applied one day leave but taken 3 days off, so i got call from manager that please apply leave, i said i can not come early, please provide more leave or LWP, but he denied and said to report in office. so i resigned on the same day and said that i will come in next week and will do all no dues formalities and what ever amount HR say i am ready to give but can not serve notice as i have to go back.

They did't say any thing and rejected my resignation and replied that you are terminated as u did not report in 3 days. I have mail which comes after resignation and after resignation rejection both. Than after 7 days i got mail for amount pay (No dues). It is written there that if u will not pay we will not clear no dues and will not issue letters (which letter they did not mention).

Next day i paid amount and send screen shot of that (I have mail). Than i asked manager to issue no dues letter, experience and other letter, he replied in mail that "yes it is in progress".

Now my concern is this :

1. if they will write in letter terminated than will it impact in other company joining. Actually my joining in other company is in mid sep 2013.

2. I paid money, had in touch with all but still they did like that, anyways manager is so good he understand the situation but now what to do.

As Saji asked ya i did not have enough leave and all is that i have in written in mail.

It is assumed that since you have applied for one day leave and did not report to your duty, they have treated you as Absconder and asked you to report immediately, for which you denied and resigned, that's why they terminated you.
The only way is to approach your company and calmly explain the problem faced and amicably sort the issues out. They can change the letter if they desire so

Hello friend,
Be truthful to your company, where you are working now. Approach the boss and tell him what happened with you. Collect some written or printed record from your mail box, show him. He will understand you.
But remember to be truthful, what ever you tell or say to him.
