Dear Sir,
Kindly provide us the details of Employer's Liability in case of Snake Bite and Natural Death due to failure of any Organ such as Heart Attack while on duty of an employee.
As generally we know that W.C. Policy covers only Injuries while on duty. Whether snake bite on duty is also covered under W.C.Policy?
I would be grateful, if any Case Law details are made available.

Yes, the Act includes the provision.
"Death of a workman due to snake bite while on duty will amount to 'accident'.
Taj Khan Hnusa v. Patel Prevbha Neemuch, (1999) 81 FLR 607: (1999) III LL) (Supp) 1246: 1999 LLR 63 (MP HC)."

Generally natural deaths are not included in wc policy. But it will differ from case ot ocase...

This is what I was waiting for. When we read about an act, its implementation remains a far cry. For someone who has never worked in manufacturing sector, it can be largely misleading.
Please share more on how is it treated and what are the things that must be taken care , in case such an accident happens.

ECA speaks for " Arising & in course of employement " in natural death there is rare chance of having relation of injury / death " Arising & in course of employement " hope this will help to the members.....

I feel there are some cases where courts awarded compensation in case of natural deaths also. As said it depends on case to case and correlation between death and nature of work.

If the employee dies due to heart attack which is induced by the stress that he faces on duty (regular stress due to nature of job or even a single incident - shock induced heart attack, etc) will also be covered under WCA for compensation, however, it is a point to be proved before the WCA Court in the claim petition. Chances of awarding compensation are high in such cases.
