Hi Team,
From Jan 30, 2012 to May 31, 2013 i worked for a company. Due to some internal problems with their partner company, they stopped paying me salary from March and i resigned my position there in april and my relieving data was given as May 31. And now when i ask them for salary, exp and relieving letters, they are saying that as they have paid till feb for me they will give my exp and rel letter till feb 2013 only.
could you please suggest what how i can proceed on this.

Let me be clear on the following

1. You resigned job in April 2013 but What did they say about your notice period and on your resignation? Did they confirm your resignation through mail? when did you ask for Experience / Relieving letter? is in April or May or June and did you ask for salary Ex letter & Relieving order after relieving from the Company ?

2. You said you resigned in April but tell me did you work for April & May? and tell me whether they committed anything in written that the salary for March & April will be paid shortly?.

3. Have they not paid salary for all the employees in your Company or only to you?

4. I understand that they are ready to pay you the salary for the days you worked but they refuse to give Exp letter & Relieving letter mentioning till May. Is it correct? If it is so, Do not worry about it. Ask them to give as they wish but let them justify it in writing. if they are not ready, try to have a proof for the salary they paid till May for your support during the next interview.

5. Your Company has no rights to hold your salary and they can not threaten you without paying salary for March, April & May as you worked for these 3 months. If they are not ready to pay, you can take a legal action against them.

Yes i have resigned on April 27, 2013 and served my notice period till May 31, 2013. In email they mentioned my last working day also. And i have asked my documents on May 31st and also keep on asking them from that day to till today.

Yes I worked till May 31 2013. And no they did not said anything in writing.

We are 3 resources working for their client and we three did not received.

They are ready to give documents till feb immediately but i will be losing 3 months of experience and regarding salary they are saying they will pay when all the issues are resolved. And also they are not ready to give any proof in written that i have worked till may. regarding Salary proof they said anything about it till now.

5. Your Company has no rights to hold your salary and they can not threaten you without paying salary for March, April & May as you worked for these 3 months. If they are not ready to pay, you can take a legal action against them.



And they do not respond to my emails and if i call them they treat me as a stranger and talk to me very harshly. No minimum respect and iam going through all this stress since 3 months. Now i do not know how they react to my background verification in future if i go legally. Please suggest in this regards.

If you accept the experience Letter and relieving letter till Feb, then they have strong weightage on their side legally. So it is advisable not to accept the relieving of Feb, Send a letter with registered post with acknowledgement receipt of UPC stating that if they wont give you the relevant documents till May and the salary thereof, you will be forced to take legal suit against them. Mark a copy to the District Labor Officer/Commissioner.
If they wont respond then you have a strong point to fight legally.
