Dear Seniors,
I am working as HR Executive in a Construction Company since one year.Very recently Officials from Labour Department has visited our Company and made observations for not making compliance under Workmen Compensation Act.Since I am new to field,unable to comply with their Observations, all seniors are requested to advise and guide me as regards to the procedure to be followed under the W.C.Act.

Hi Pavithra
If any inspector is visited then he would have given the checklist to submit the documents. You get those documents prepare those and comply as per the advice from the officers.

Dear Sir,
I have not received any check list from the Inspector except the Observation Slip.I have to submit my reply along with Compliance with in a week.Request you to send me the details of documents to be submitted.

All those who are covered under ESI scheme will automatically get covered under WC act. For all those who are exempted from ESI, please take a policy under WC act from any nationalized insurance company.

We run a 50 bed hospital for tribals in the Nilgiris. Would someone be able to advice me about the rules regarding ESI for our staff? They have PF and gratuity benefits. If ESI is not required, would they need WC as mentioned here? Thank you.

There is no compliance under EC Act until an employment injury occur.Some state rules prescribes publication of extracts of Act and Rules on notice board.
The post by Mr Muralikandukuri that all who are covered under ESI are covered automaticallynder EC Act is wrong.Employees covered under ESI are not entitled for the benefits under EC Act.
On the query of Dr Shylaja, All your employees irrespective of nature of work shall be covered under ESI if there salary is not above RS 15000/pm and your place is an implemented area.The benefit for others is your discretion.But fif any employees defined in schedule two of the EC Act is working under you they are entitled for compensation and reimbursement of full medical expenses if they meet with an employment injury.
