My self working in a ltd company from sep-12 company started to pay half salary till dec-12, from Jan-13 company stopped to pay the salary till writing this problem. I had an savior accident while on duty. but company didnot paid a single penny against balance salary for hospital treatment. during Nov-12 to Jan-13 reporting manager marked me absent without reason. now I am asking about when salary will get paid to HR & accounts but getting answer they don\'t know. it is known by CMD only. mean while as on 1st may 13 CEO marked mail to every one that during this month i.e. May 13 all the balance salary will get paid. but till date no single rupee received. and management is asking to resign from the duty and all dues will get paid after 3 months. How can we believe on this. Is there any legal way to solve this problem. Pl reply

Hi,
As per your query, you have to clarify one thing, Management issued any Appointment Letter or nor? I m wondering how you worked nine months in the organisation without paying the salaries...?? If management issued the Appointment letter you can directly approach concerned Labour Department Officer and give the written complaint against the management regarding your unpaid salaries. Management have no rite to ask the resignation without proper reason if they want ask resignation should give one month notice or one month salary as per your Appointment letter.

Dear Shrini
Management issued the appointment letter to me with stating the work location at Aurangabad Maharashtra dt 9/1/2012. I contacted to the Aurangabad Labour department/officer but they are replying that company is based at Ahemdabad Gujrat hence this matter does not come under our jurisdiction. after words I contacted to Labour Court but while issuing the notice to the employer judge objected that "if we will issue the notice but how we will apply it?" Now advocate is working on the objection since last 7/8 days but not getting any positive output.
Hence requesting you that If you have any suggestion/guidance pl help me.
