Good morning!

I was working with an organization from 6th April'11 to 30th Dec'11. I had sent a formal resignation email from my personal email account to the Sr. Manager and informed them that I would not be able to serve the notice period & need to leave from the organization on an immediate basis.

I had received received an email within 20mins from that manager stating that CAN YOU CALL ME? and then we had a talk over the call regarding my resignation. I was trying to make him understand that I am leaving organization because of my family issues and not just because of joining any other organization. He didn't tried to understand my problems and was not ready to accept my resignation as well.

When our telephony conversation was over, He sent an email stating that they are not accepting my resignation and If I will not pursue my duties as per the schedule then they will take the legal action against me. I did not replied on that email and went back to my home town to my family.

Fortunately, I was able to solve out my all the family problems started trying to search for a new job and got another one almost after a month! That organization did not asked me for my relieving letter and asked for only my resignation email sent to them and I got the job with a good package and position.

Now, I am getting an opportunity to work with another organization which is an MNP and also giving almost double package with a position. They have asked my relieving letter from that organization and did not accepted my resignation email sent to them! I am quite surprise that the same has been accepted by the current organization !!!

However, I have tried my level best to convenience my previous organization's Sr. Manager to whom I spoke to previously and tried to make him understand about my condition. He didn't listen to me properly and disconnected my call.

Furthermore, I have had sent an email to him after having word with him over the call but as expected he didn't replied to me. After that, post 3-4 days I had sent another email requesting to the CEO of that company for the relieving letter. Mr. CEO replied to me back stating that as per the HR records I was absconded and also I was doing job with the two different companies at the same time so ultimately I was at the fault but they didn't taken any action against to me.

I would just like to bring into the reader's notice that

1) This company does not have particular HR department or a Person

2) They didn't sent any warning letter or absconded letter at my address

3) As per my knowledge they do not have rights to stop any employee if they do not want to work with that organization anymore. And secondly, I was leaving that company die to personal issues.

4) They have had not contacted me on the very next day when I didn't turned up for my duties

5) They didn't sent me any emails further stating that they are considering me as absconded.

Team, honestly I am stressful and do not want to loose this opportunity to work with that MNC. It is a life time opportunity for me.

Humble request you to please revert on this at the earliest.

From my view the faults are as elaborated.

On your end, though you sent and email of resignation, thereafter talked to your senior over the phone explaining him the reason to resign and then your senior rejected your resignation on email and asked you to resume on immediate basis.

What you did was ignore it and never replied back. This was a fault on your end as you could have very well replied to your employer about the decision you are taking. Might have register AD the resignation requesting acceptance and relieving letter and things would not have been this way.

On the company's end, they should have done their part before marking your absconding. They should have enough evidence to prove they contacted you and mailed you a warning letter stating if you did not join by so and so date you would be marked absconded.

Now no matter who is more faulty, understand that the one who is going to be affected is you and your career.

Regarding the new MNC who is asking you for relieving letter is not at fault as they are following their company's policy.

Instead of putting allegations on the ex-company why not instead think and act. Put an email to the concerned person by telling him that there were no warning letters issued to you saying that are you are being marked absconded and hence they marking you absconding is not right.

Another thing, what reason had you mention on the resignation letter. Knowing that you too are at fault they can very well try to put the blame back on you. The reason I mentioned you the faults of both you and your company is so you can plan your further action accordingly.

Usually a company seeks relieving letter from your current employer and not the previous employers. You can try and get your mnc convinced that you would get relieving letter from your current employer. About the past getting relieving letter is little difficult because of so and so scenario.
