Dear all,
one of my friend companay,the employee are ready to accept to stop pf contibution and they are ready to claim the pf amnt till date and want to cont as new joinee.and basic +da is above 6550/-.
now tell me in above case is it leagl as per PF act,
and esic also can be stop or continue for the same employee on the same emp code or concidering them as new joinee and strat esic contibution on the same ip num.
please brief in details,

Dear naagacharyd,
You can not stop the contribution of PF under any circumstances. Once an employee is a member of PF he remains member of PF till last.
The tact which you are going to adopt is unethical and illegal. If you do, you will land in great trouble.
ESI also you can not do any thing. My suggestion you increase the gross of everyone above Rs. 15000/- p.m. and decovered them from ESIS. You will save lot of money of your company.
If such things are possible, every one will adopt the same tact of you and there will not be any social security law in existence in India.
By the way, are you a HR guy? In many post I observe the HR guys are writing in the name of their friends like you did. If it is a fact that this case is of your friend only, why your friend is not writing and what is your interest in writing for your friend? Please pardon me for asking this question.

Keshav Korgaonkar is right that EPF can't be stop during the continuity of job, if the employees wish to stop this facility they first tender their resignation and withdraw the same and after one month they can join with new payroll.

First, they will have to resign, wait till they withdraw their PF amount, and then join again
What will you do till then ? Shut your factory down ?
In any case, the PF department is likely to investigate and initiate proceedings against you for fraud
