The white collared employees are not governed by any specific laws unlike Labour laws.So leave are given as per the Organisational Policy. To take a guideline from Factories act,Consider a year as 240 days and give 1 day leave for every 20 days worked. That comes to 12/12.5 as per the days in a year.No upper limit for leaves.

dear friend
please refer to mr pallagulla raguram's fwd .pdf file
it appears that he must be in public sector or government sector institute.
if u are in private sector
if u give all the leave recommended in the .pdf file you will become non productive or you have to employ addl people [ of course u will be paying them and giving them leave]
watch out when u make a policy
quantity of leave or en cashing of leave is a company policy .
CL ONE DAY A MONTH
SICK LEAVE - ONLY WHEN SERIOUSLY SICK NOT MOE THAN 6 DAYS . SPECIAL SANCTION IS REQUIRED
SPECIAL LEAVE NOT MORE THAN 6 DAYS IN A YEAR FOR ANY DEMISE / ACCIDENT ETC IN THE FAMILY .

Hi,
Leave policy should follow as per the labour act's like Shops & Establishment act (or) Factories Act. Normally CL -12, SL -12 (who are not eligible for ESI) & EL - every 20 days working 1EL. All Leaves should be pro-rota basis only.

Friends, there are different opinions among people because leave patterns are different in organizations... actually customized as per their requirements. As per my understanding below is the requirement from department..

Earn Leave - depends on no of days worked in last calendar year, one leave earned against twenty working days of last year, maximum 14 days earn leaves are allowed.

Sick Leave -

A. The employees who are covered under ESI - I couldn't found any act/notification where SL is mentioned as necessary for this category employees. It depends on organization.

B. The employees who are NOT covered under ESI - must be entitled for 10 days SL

Casual Leave - not mentioned, depends on the orgnisation.

Annual Leave/Festival Leave/holidays - Minimum 8 days...(three national holidays are must as republic day, independence day and Gandhi jayanti). Process industries can work on all these days with prior intimation to department.

Kindly let me know with reference of govt. notification/act if anybody find the any of above information incorrect.

Regards

Sanjeev
