Dear Seniors,
Need your help, suppose employee who falls under ESIC, goes on maternity leave, kindly let me know the procedure of Maternity payment/salary, do company has to pay for 3months or ESIC will pay for the same.

Dear Deepak ji,
The female employee who is covered under ESIS proceeds on maternity leave, the employer is not liable to pay her maternity leave / benefit.
The ESIC is liable to pay her maternity leave / benefit. But for this, the female employee is require to take certificate leave from the ESI panel doctor with whom she is registered or from ESI hospital and submit it to ESI Branch office to get the leave salary and other benefit.

Maternity benefits are available under the provision of ESI Act. It is subject to a condition that payment of contribution for a minimum of 80 days should be made in one or two consecutive contribution periods. In such case ESI will provide Maternity benefits.

Now, I have a question. When a woman employee i.e. I.W. disqualify for meternity benefit due to less number of days of working, is employer liable to pay maternity benefit to her?

To my knowledge i think employer is liable to pay maternity benefits in such case as Maternity Benefit Act would apply. Please correct if am wrong. Regards, Suresh

Please find integral information regarding Maternity Benefit eligibility conditions etc. A careful reading shall clear all your doubts. Further to clarify that the Delivery need not essentially take place in an ESI Hospital. ESI Dispensaries shall accept the private nursing home delivery certificates and shall issue the certificates relating to maternity basing on the \"recent signs of delivery\" For this the delivery should be reported to the Insurance Medical Officer immediately after the delivery. Now the following are the paras from ESI Branch Office Manual: Eligibility of insured woman to claim maternity benefit is determined by the provisions
contained in sub-rule (1) of Rule 56 of the ESI (Central) Rules, 1950 which says that “an insured woman
