Dear Seniors
i wanted to know a querry about PF, one of my friend has quit his company and applied for pf after two month but company is not processing PF application coz the company thou deducted from employees but they have not remitted the amount to PF office. not only one staff there are lot many people who are facing same problem. Kindly suggest any suitable action to get PF amount.

Please share the resignation date of your friend and the date of filed EPF claim request and status of claim first
Also I would like to know how did you /your friend get that company has not done their job or say, not deposited the deducted EPF amount to EPF office. Moreover, seems to me, your friend has never tried to have any communication with HR department of employer/company otherwise he/she would have known the reasons of this problem. Therefore, how can your friend and you claim this?
The best way is to meet HR Department personnel of company directly before assuming about company’s work system and procedure and claiming that they are not working properly. Ask your friend to visit your company and tell the status of your claim request, they will certainly give answers of all the questions of your friend

thank u for ur reply, i wish to bring to your notice that company has not remitted amount to PF since one year and that is the reason they are not processing claim forms given to HR dept. Whenever he is meeting HR, he is directed to meet admin, who says company is having financial problems and will settle things soon but no definite answer. it is not that only my friend's claim is pending since last april, people who have left, they all r facing the same problem.
Kindly advise what the suitable course of action.

No matter company has financial problem or what, they have to file their EPF returns which is one of the statutory conditions and as soon as they will perform this task and the EPFO will update it with their system, claim procure can be adopt.
Second, now you also knows the main problem that is bothering you and not just to you but to all the employees who are on the same terms and to employer itself, therefore, you are advised to wait for some more time until employer done with their EPF return, and later you can process your EPF claim request.
However, rest assures your every single paisa deducted by employer on account of EPF contribution by employee/you and their own share (as per statutory condition) is all yours always.

No problem your friend can direct approach to the regional PF office and meet & Complaint to PF commissioner or PF Recovery Officer and provide your friend EPF number and establish name .Then will proceed and chance to freeze thier company account direct to the bank account by providing attachment order without the company knowledge.....

I haven't heard this before. Why EPF will freeze the company account without the Knowledge of Company, direct to which bank account???. Kindly Elaborate?

See if employer has not paid the challans then it is not possible to get the claim, but the solution According to me is that the person can approach to the regional PF office and can make the complain with the proof of PF deductions from his salary . The Inspector will inspect the Company , check whether the Challan are paid timely with the exact amount. If Challan are not paid then Company has to pay all the due challan along with the Penality Damage fees of late payment with the interest, and it can be a huge penality as employer has made the deduction from employee side and not paid to EPFO . For online challan no returns are required to be submitted. Only after this the EMployee can get his PF Claim.

But one more question is that while being on job why didn't the Employee didn't asked about Yearly PF Slips. PF slips contains all the statement regarding your previous year balance , year ended deposit and the interest paid.
