Dear All,
I am working in one construction industry in state of Gujarat. We have engaged Contract Labour on Daily Wages Rate. We are paying Monthly Wages on the base of Daily Rate Of Minimum Wages.
My query is whether this Contract Labour are eligible for the company's declared National & Public Holiday. Means, On declared holiday if we don't get any work from this contract labour than we need to pay them for this day.
Kindly advise me on this matter with some legal & Statutory references!!!

National and Festival holidays is applicable to all workmen even contact labour also.
Contract labour are entitled to get wages for the declared national and festival holidays even though you are not provided work to them.
Suppose an employee works on a National and Festival holidays, he shall at his opinion , be entitled to twice the wages for the holidays and substituted holiday with wages on any other day.
As per The Tamilnadu, industrial Establishments (National &Festival Hoildays )Act, 1958
Wages should be paid to the employee for a Festival holiday if he has completed a period of 30 days continuous service within a period of 90 days immediately preceding such holiday.

To make it clear, An employee who works on a National or Festival Holiday is eligible to earn Three day Salary. i.e, One day wages for Holiday and Double wages for Working on a Declared Holiday.
