It is necessory for an employee to complete 1 Calender year to eligilble for Annual leave For Example My DOJ is 18.04.2012, and i have completed 240 days working but i havent completed Calender year that Jan to Dec
am i not eligible for Annual Leave?

Dear Ms. Dipti Sharma09,
Those who are in continuous service in the preceding 12 months (should work not less than 240 days) are eligible for E.L. during the subsequent year. If a person joins in the middle of the Calendar year, he is not eligible for Earn Leaves until completion of 12 months service. Thus, you are now eligible.

In my company , there is a policy that if an employe's DOJ is before 15th jan he is eliglbe for annual leave in next year i.e jan, but if employe's DOJ is after 15 jan or feb ,march so on then he is not liable for Annual leave in next year. even for this he has to complete Jan to Dec i.e Calender year.
According to my company policy, i am not eligible for annual leave yet i have complete Jan to Dec Calender year
Kindly suggest me if this policy is valid or not?

Dear All;

Everyone is entitled to Earn Leave. It is immaterial when he joins during a year.

When employee is in service from 1 January till 31 December, then completion of 240 days of actual work is necessary for entitlement of Earn leave.

When an employee joins after 1 January and works till 31 December then he will be entitled for Earn leave if out of calender days from his date of joining till 31 December he has actually worked for minimum 2/3 days. If he has worked less than that, he will not be eligible for earn leave.

So is the case when anyone is in employment on 1 January and leaves in between a year the 2/3 of actual working days out of the available calender working days is the criteria.

In this case the question maker claims that he joined on 18 April and worked till 31 December and during this period he worked for 240 days. It seems impossible for me. There must be some misunderstanding or miscalculation. From 18 April to 31 December there are not 240 working days, how can one work for 240 days?

A sound and legally compliant policy shall permit any employee to have the earned leave accrued during the calendar year whether he joins in januray or in the midst of the calenedr year and in the case of the latter(middle of the yaer), the leave shall accrue proportionately, whether or not he completes 240 days.
