elgiblity of giving bonus is correct but here the question is if the company is making losses ,then what does the law say ,& what provision can be made should be suggested Jaithacker

Dear Mr. Jaithacker,
Bonus is at liberty to employees. Eventhough company is in loss, a minimum of 8.33% should be paid as a statutory liability. The provision is stipulated solely in terms of the appointment and any such bonus hitherto shall be entitled at its minimum even in case of company running at loss.

Dear Madam Sharmila ji,
My company is only 4 years old and running in to losses. Is company liable to pay me bonus?
If there is no stipulation in the appointment letter or no appointment letter is issued to me, then what?
Kindly enlighten us on it.
