Dear Sir,

As per the Rules & Regulation for payment method. we are working in PSU.

we are appointed labour supply agency for supplying labour as we can not directly recruit labour on contact basis. But we are maintaining all document directly by our self but except the payment . we paid to our labour through agency. Somehow our client object on making payment to our labour through other agency as because we are not issued form V to our agency.

Document which prove that the liability of labour is directly on us.

1. we are maintaining the muster roll, and we are also issuing wages slip directly to our labour.

2. we are issuing employment cards to the workmen.

3. we are maintaining statutory registere of all the workmen.

4. we are maintaining the workmen register.

5. we are deducting the PF & ESIC and depositing the same trought our cheque.

As we are directly transfer the amount of wages of our labour through NEFT but through other agency cheque.

So, please suggest how to come out from this situation.

Dear NPMB,
I have doubt how you can deposit the PF & ESIC from your account?
as you have hired the labour through any Agency then PF & ESIC will deposited by that agency's Account not directly by you.
it's mandatory to issue form V.
Agency will Pay Salary Slip & Job card on own his name.

1. Can u share us wht is the employee strength of labour supplier agencies in ur organisation?(whether below 20 or not)
2. Any work order has issued to the Labour supplier or not( If possible copy of work order)
3. In wage Slip and all the statutory records name of the employer is the contractor or not ?
4. Since u r PSU u have ur own pf trust or depositing pf amount in EPF office

Dear Sir,
Since you have outsourced to an agency for supply of labour, you are not supposed to maintain any register on your own. Contractor has to maintain Muster Roll, Wage Register, O.T. Register etc. Principal employer has to sign on the wage register to ensure that wages are disbursed as per the entries made in the register. Principal Employer has no direct control on contract labour. Payment of EPF & ESI is the responsibility of the Contractor. Since contributing EPF & ESI schemes is mandatory, Principal employer has liability to see whether the contributions are remitted by the Contracot properly or not.Principal Employer should not issue pay slips, identity cards to the outsorced workers. Contractor has to fulfil it.

you should discontinue the prcatice of maintaining registers, paying PF and ESIC from your account. the labour can claim regularisation of their employment if you conntinue the current practice.
