Dear Tushar,
According to "MICRO, SMALL AND MEDIUM ENTERPRISES DEVELOPMENT ACT, 2006" under sub-section(1) of section 7, Micro Enterprise is where the investment in plant and machinery does not exceed twenty five lakh rupees and Small Enterprise is where the investment in plant and machinery is more than twenty five lakh rupees but does not exceed five crore rupees; and last Medium Enterprise is where the investment in plant and machinery is more than five crore rupees but does not exceed ten crore rupees;

I have a further question on this matter. The Act mentions: "Small Enterprise is where the investment in plant and machinery is more than twenty five lakh rupees but does not exceed five crore rupees". My question is, this limit of 5 crores is for one factory or all factories run under a company name? There is a lot of confusion where some people say this limit is for factories within a district; while others say this limit is factory wise. Please can you guide on this.

Act do not specify about pattern of investment. It only specifies about in vestment in plant and machinery. On the basis of your input, I believe that your company have different units under one name. Hence total investment will be considered for applicability of sub section 1 of Section 7 of under the MSMED Act 2006.

True the Act is not very clear on the pattern of Investment. Is this the general practice, to take total Investment in the Plant & Machinery for the company as a whole, even though it has factories located in different states with less than 5 crores investment(for small enterprise)? The factories are under the same name(ie. company name).

Dear preetyka_78,
I endorse your view that the Act is not very clear (alike other laws). I further add to it, what I feel always, that our law making machinery always keep us in ambiguity intentionally so that bread and butter is on for many. The root cause of corruption in India is this only. Laws are not made clear, they not practicable. Even Anna in thousands can not save India from corruption. Other day some one said that because of Anna, corruption is multifold now. I do agree with him with cent percent with due respect to Anna. Today officers tell us to follow the law.
(Sorry Anna ji to call you Anna.)

Hi All,
I would like to share more to this. the government authorised persons who make act must be calculating the profit from it getting to them and not to government so they are pre-corrupted ones.
because of them general people need to bear everthing
correct me if wrong anywhere.

Is it possible to register IT companies as small scale industry? If so, is it legal to issue experience letter to their employees?
