My company is into BPO (US, domestic and national projects) and we are located in Chennai. As per them they have defined 12 days of SL & CL and 12 days of EL.
My question with the mgt was SL and CL should be differentiated, for that they informed it is clubbed as total 12... And no were in the law it is written. And finally they ended up saying that they will revise SL & CL as 10 days and EL as 12 days.

Hi All,
Please conform my analysis, from your posts and clarify me on the same.
An employee is eligible for 7 Casual Leaves, 7 Sick Leaves, 3 national Holidays, 5 festival Holidays along with Earned leaves of each one per every 20 working days.
In that case, the total count of leaves to be provided should 7+7+3+5+15 = 37. But, we have a internal leave policy, where employees get 15 Earned leaves on a pro rated basis of 1.25 every month, in which we have specified those 15 earned as 7 Casual leaves, 8 sick leaves and 11 company holidays covering festivals and national Holidays. So, we are providing only 26 leaves to the employees. Do you think employees are exploiting in this case?

as i told to you for leave policies, no matter how many days total for leave, all facts depends upon the indian labour laws, you may have your leave policy but you have to follow the minimum standard of leave provided in various labour laws.
for more clarification
all those employees covered under esic act are not entitle for the sl
EL one for 20 worked days in factories act under leave chapter.you are not suppose to manipulate the factories act, 1948 sec 79
3 national holiday and
5 festivals holidays are also compulsory you can not escape any way under labour laws
(5 festival leave are depend upon the state festival holiday schedule you may refer that)
being in hr we have to insist the management to follow govt labour laws
working class have been always exploited this way or that way no matter but you have to keep updated your self

1- My factory is situated in Bhiwadi -Rajasthan (Leave Policy applicable Factories Act or Shop and establishment act)

As per TN S&E Act, it is 12 days EL, 12 days CL & 12 days SL to be given and an accumulation of 45 days for the purpose of encashment during separation is allowed.
