Bonus to contractual emplyees
Dear all we have taken one unskilled person on outside contract for housekeeping job. the contractor is charging us on monthly basis the bonus 8.33 which is usually paid to the employee annually in october. in this regard i would like to know the following: 1. whether we should pay the bonus or it is liability of the contractor? i think the contractor should pay the bonus out of his profits and should not be taken from the principal employer. 2. i came to know from some sources that if your company pays bonus to all your regular employees then you have to pay to contractual also. is it true? 3. if it is to be paid by principal employer then what are the documents we should ask the contractor for bonus payment like bonus payment slip etc. kindly suggest. best regards priyanka

Dear coleagues hi i have to discuss some queries reg to cintrcat labour 1. can any one advise whether a contractor labour is eligible for bonus as per recent ammendment in payment of bonus act? 2. if a contractor removes his workmen from the job after one year of service what type of benefits he is liable to get from the contractor/employer. please suggest thanks & regards ajay kr sinha
Liability of principal employer on payment of bonus
A company hired employees through a contractor under contract labour regulation & abolition act. contracted employees are engaged in seurity service gardening peon and also in maintenance. contractor pays the salary/wages to these employees and submit his bill to the company with his service charges.my queries are as under: 1. whether company being a principal employer is liable to pay bonus to the contracted employees in case the company pays bonus to its regular employee. 2. what would be the position if the contractor does not pay the bonus to these contractual emplyees. 3. please inform about any notification of ministry of labour/citation of case laws on payment of bonus to contractual employees. ramesh sharma
Non payment of bonus by the labour contractor
Dear all we have engaged a labour contractor since 11th jan 2007. paying them bonus at the rate 8.33 per month amounting to rs. 221/ pm. i know bouns should not be paid to them on monthly basis but since this clause was included in the agreement we had to pay the contractor has been taking the bonus amount from our company on per month basis but he actually has not paid this to the employee. i have asked them to submit the copy of register 'c' before 15th jan 2008 otherwise i will deduct the money rs. 221x12 months rs. 2652/ from the payment for december 2007. kindly suggest how should i proceed in the matter. best regards priyanka

Bonus and leave allowance to contractual employees
Dear all i have recently come to know from my senior that now it is compulsory for the contractor to pay bonus and leave allowance to their employee. is it true. if yes then should the contractor charge this amount to principle employer every month. is there any responsibility of principle employer. as far as i know principe employer is responsible for the wages payment only which does not include bonus and leaves. kindly clarify. best regards priyanka
