Dear Friends, I am working in a small concern which has around 20 members. Previously our office timings is 9am to 6pm. Now my manager ask me to know the office work hours as per companies act 1956. Kindly any professional guide me regarding this

Hi Office time are as per the local laws applicable if its not a factory then Shops & Establishment act need to be checked.

In Bangladesh normal practice of office time is 8 hours. If start at 9.00 am will be close at 5.00 p.m. Lunch and prayer break will be within this period. But any one who has pending task he has to complete the task in that case no time bar. But according to the labor law working time is Eight Hours. After eight hours every worker will get the overtime which is mandatory for factory workers but not officers

No.of Hours working should be 8 hours in a day (including breaks) and 6 days a week, can be from morning 8:30 am as per the Law for women.
If a company is having shifts, each shift has to be framed with 8 hours (8 hrs x 3 shifts = 24 hrs a day). Women employees are not allowed to work in the night shifts, but still there is an exemption if they are provided transport facility and with a women security while travelling.
6 day a working - shifts: 9 am - 5 pm or 9:30 am - 5:30 pm or 10 am - 6 pm.
If 5 day a week - 9 hrs a day , 9 am - 6 pm (or flexi timings as per the companies requirement) - but it is not as per the Law, it is a practice by the IT Companies.

Thanks to all for your valuable suggestion. But still i would like to know as per law. what about the duration of lunch break? Whether this 8 hours include the lunch break?

Dear Nithi,
I am working in an airline's commercial department.We have 44hrs week.We have only one weekly-off day.Now this 44hrs divided by 6 working days means 7hrs30mins duty everyday.However the break time officially allowed is 45mins.Management allows 45mins break but considers 15mins as employees own time.You can say that it is 30mins paid break and 15mins authorised additional break without pay!

As per Factories Act,1948, 48 hours per week, ie 8 hrs per day , this does not include break. if you want to give break for 30minutes lunch break,then add 30 minutes to daily working hrs , then then daily working hrs become 8.30 per day

Section 51 of Factories Act says that no adult employee should be allowed to work for more than 48 hours a week.Further, subject to Sec.51, no adult employee should be allowed to work for more than nine hours in a day.
The duty hours may be in General Shift i.e from 08.30 am to 05.00pm,or 09.00am to 05.30pm;OR,in A,B,or C shifts. The periods of work of adult workers in a factory each day shall be so fixed that no period shall exceed five hours and that no worker shall work for more than five hours before he has had an interval for rest of at least half an hour.
The rest hour is exclusive of the total working hours.Thank You.

Under various acts pertaining to labor and Workers (Factories Act or Shops & Establishment Act) fixes 48 hrs weekly for all workers if it;s 5 days week they can be divided in 5 days if office is opening for six days then it's 8 hours daily. Therefore you can tell your Boss that maximum hours permissible under labor Laws is 8 hours and 9 to 6 is 9 hours which means 9X6=54hrs which is against the land laws. If any dis grunted employee file a complaint against Company with labor department, they will be in trouble.

I would refer to your original question that your manager asked to know the working hours as per Companies Act, 1956. The fact is that the Indian Companies Act, 1956 does not lay down any working hours either for an office or for a factory. This point has not been clarified by any of the participating member in the replies/views given above.

Secondly I would apprise that working hours of an office are governed by local laws of each state which has its own Shop and Establishment Act. The working hours of an office are 8 hours per day on the analogy of Factory Act wich permits 8 hours working. The timings can be decided by the Management. Commercial organizations and office establishments can observe different set of timings under the applicable laws. You have not asked for lunch timings, but the standard practice is to observe half an hour's lunch time.
