Our is a mining company, and we usually pay the leave wages to employees, i.e. whenever employees are taken leave they are marked absent and half yearly we pay the proportinate leave wages as per their present. Kindly let the know the following and as per Act / clause.
For payment how daily wages are arrived. Salary is fixed for employees on montly basis. This doubt has arised since in one of post in CiteHR in have read that for computation of Gratuity no. of days is considerd as 26 where as for retrenchment it is considered as 30.

The practice appears little self-contraditory. if you mark an employee 'ABSENT' on the day of his absence and not 'LEAVE' , then are you not deducting his wages proportionately, since such absence is not supposed to be with the permission of the mangement. Leave is the absence permitted. If you are paying him wages, then you are regularising his absence and it is possible only when he is sanctioned leave .

you are confused Mr. Prince.. if you marked absent then no need to consider leaves later on and if you want to compensate then give leave and don’t mark absent. Be clear be sure.. Chill HR

Mr Prince ,You should have to follow the provisions of Mines Act 1952 .Persons who are entitled for Earned Leave may be asked to submit EL Appliation for absence period and same may be sanctioned .Pl calculate one day payment by dividing monthly salary by 26 ,not 30

Gratuity and Retrenchment benefits are different issues ,however Gratuity is calculated 15 days wages for every completing year of service ,taht means 1MONTH SALARY / 26 = one day salary x 15
