Dear all, All my employees signed the bond of service agreement for 24 months and 36 months.
What action could be taken if they break the bond and give the notice period of one month? They had just signed the agreement without informing if they abscond, how can we retain that employee. Can you please suggest?

Company cannot insist the employee to pay the bond amount when they resign, as it is not legal and if the employee complaints to labour office, they can take action against the company. Moreover, the bond has no legal validity and the labour office will favour the employee only. As per the court order, employment bond is not permitted by no organisations and if any employee resigns without serving the bond period or notice period, he/she should be relieved as per their request and experience letter/relieving order should be issued to them The company cannot confiscate the certificates of any employee as surety for the bond.
Employee retention is great challenge to any organisations and it requires careful approach. The HR should inculcate strong bonding between teh employer and teh employee and teh employee should feel that hey are taken care of by the employer.
regards
devi
