There are two ways of contract:
1) Contract of Labour
2) Contract of Job or Service:
In first the labour are taken on a third party contract for doing the job.
In second, the contractor is paid lumpsum amount to do the job, irresepctive of no. of labour employed to do that job. At the end of the day copmany is concerned amout the output, resluts produced, (with how many employees is the problem of contractor).
Hence housekeeping, gardening, security is consdidred job contracts.
In your case, copmany hiring individual employee on contract is considered Fix term contract. This practice can be lethal in future.
I think no, as per the law every employee liable for all the benefits like employee, but the way is different like ESIC, if the employee under FTC then he is liable for some percentage on ESIC contribution, but if we appoint the staff for some short period like 10 days 15 days, as we as variable staff then they comes under the group Insurance. So there is so many conflicts.
