IT firms are not under Factories Act for the time being.A case is pending in SC on whether IT activities are manufacturing process or not.In a case under ESI Act the Bombay HC has held in july 2012 that it is manufacturing process and IT firms are Factories for ESI purpose.Wait for such decision under Factories Act.Till then IT firms are under Shop & Commercial Establishment Acts of the respective states.
