Domestic enquiry conducted in unfair manner...
Dear all i am working in pvt ltd company. my company management misused workers pf money which they had deducted from workers salary. i raised that issue and due to that was filed. now the management targeted me and suspended me in november 2014. now the enquiry is over and in whole enquiry management failed to prove the charges which leveled against me. but even they failed to do so still enquiry officer is giving his judgement against me. in his reports he showed that i found guilty for the charges. now is there any steps which i can take against the enquiry officer for his unfair enquiry conduct.?? is there any steps due which i can dragged that enquiry officer in court for his unfair enquiry report?? please advice me as i am totally disturbed due to this reason. thanks mangesh n.
Gratuity from joining date or from gratuity and pf scheme introduction date?
Kindly i need some information about gratuity and pf please help me. one of the employee gratuity and pf has started from june 2013. but he has joined company in 2000. whether that employee can claim gratuity from joining date or from gratuity and pf scheme introduced date.

Gratuity
My date of joining was 06.05.06. after notice period of 1 month i left the job on 30.04.11. after joining they started deducting my pf after 1 year. nothing about pf / gratuity is mentioned in my appointment letter. today i recd. call from hr that you have completed only 4 years so u will not get gratuity. can anyone help in this case ?? for gratuity date of joining is important or p.f deduction ? or gratuity and pf interlinked with each other ?

The undersigned working in a psu in mining industry. the undersigned has experienced a peculiar case. a permanent employee is absenting from his duties without any information and sanctioned leave since last couple of years. he was chargesheeted on the ground of long absenteeism case and subsequently a domestic enquiry was constituted by the disciplinary authority. enquiry was conducted exparte but the eo submitted his report & findings after a gap of approx one year and it has been proved beyond doubt and the diskciplinary case file has been approved by the competent authority . the delinquent employee did not participated in the enquiry proceeding. before imposing punishment like removal from the service the nominee of the employee appeared suddenly and submitted a death cert of employee and claimed for all terminal dues like pf refund gratuity and employment on compassionate ground . my question is upto which date calculation of gratuity will be done whether thedate of signature of the competent authority or the date of death of the employee. whether employment on compassionate ground will be provided or not. kindly suggest what is to be done if there is any case study the same may also be provided.
Moral turpitude as proved in enquiry would justify forfeiture of gratuity.
A employee who forged his educational qualification certificate during his tenure its found forged also he forged higher official signature during enquiry proceedings given ample oppurtunity and found proved his quilty. hence moral turpitude as proved would justify forfeiture of gratuity?.
