I request you all to update and clarify the query about gratuity act as outlined below:
1. Applicability of law to employees- as act says gratuity will be paid when employee leaves the Org.after completion of 5 Yrs and other side 240 days of continuous service, if you take into account 240 days * 5yrs-1200 days i.e 3.28yrs of service
2. in case of death completion of 5 yrs is not necessary, if employee died immediately within a month after joining - how to compute.

your first query is illegible, be straight that employee attains services of 5 or more year than they are eligible to claim gratuity bu filling form F. If employee has completed 4 years and 240 days of service in 5th year, than also he/she is eligible to claim gratuity
your second query is regarding how to calculate gratuity if an employee dies during the course of continued services - formula is Current basic wage amount * total years of service * 15 / 26. In such cases I seen that company's are paying 5 yrs gratuity eventhoug an employee has completed the services of 5 years, this steps is based on the ground of humanity.
