Hi
I am currently working in a Govt. Registered Educational Institution as a Lecturer. I was on maternity leave from 11.04.2012 to 27.08.2012 for a period of 135 days, as my child is very young am not in a position to leave her alone at home and work, i would like to extend my maternity leave for 1.5 yrs. As per latest amended maternity norms(dated 1.04.2012) in our state(Karnataka ) maternity leaves have been extended to 180 days, also as per sixth pay commission rule their is a provision for childcare leave for up to 2 yrs. I have submitted my leave request for extension also i have mentioned that i shall commit for unpaid leave for 1.5yrs, till now their is no fruitful response from my organization to my letter. Kindly let me know whether i am entitled to take unpaid leave for 1.5 yrs, also let me know if i can claim my maternity benefits if i temporarily quit my job.

The Six Pay Commission recommendations or notifications pursuant to it my not be applicable to a Govt. Registered Educational Institution but it is applicable to an institution run by the government where the employees get their salaries directly from the Govt. Please clarify if your case comes under the first one (that is registered under the Govt. and recognised by some statutory body like AICTE/ UGC but salaries paid by the management or simply self financing institution) or the second one that appointed through Public Service Commission and governed by the State Service Rules.

I am working in an Institution which is Govt.Registered and as well as recognised by AICTE, Salary is paid by management. Our Institution coplies AICTE rules.
Please let me know

Since you are an employee of a private/ self financed institution, your leave will be governed by Maternity Benefit Act and not by Pay commission. The management can take a decision whether to grant you unpaid leave or not. Depending upon the decision by the management you can take a break and rejoin. It is purely a management prerogative.
