Dear Swati,
You have a genuine problem and so you quit your job, so it is ok. As it is already mentioned Mr. Sameer Paranjape and other's too have told you to ignore it. Remember is you are too sensitive people will try to take advantage of you, so as I had already told you earlier also please take care of your health and ignore them.
Now as you are going to work in the future you have to always make clear what are the terms before taking up any job, always remember to inform the HR when you want to leave the job. It is sad to say that there are many organization who try to get as much as possible from the employees. They are trying their luck, if you pay then it is their gain and if you don't pay then also it is ok with them. Once again I would like to request you to ignore all this and take care of your health.

This was a suggestion given to keep the person relieved from the pressure, before this i mentioned the notice pay would not imply during probation.

Do not think more on this any further. On the other side what you think is not importatnt and not stands in the court of law but what is agreed and what has documented is more important.
You just do one thing, just pass on one requst to the management for wave of your notice persiod as you are not able to serve notice period and relieved you by immediate effect.

A two months' notice for a Trainee is not heard of. Ankita has clarified well about the notice period which a trainee /probationer or a confirmed employee usually has to serve. I think, you need to read the clauses of your appointment letter more carefully and it will solve your problem as two months' notice period may not be applicable to you at all.
Now let's talk about the practical aspect. You have genuine reason to tender your resignation which you did and the same has been accepted through SMS. HR Department has its own worries and numerous (many a time unnecessary) engagements and it doesn't have time to chase every leaving employee that too a fresh one month's old trainee. You may get a letter or two, just ignore it, be relaxed and undergo treatment. It is necessary that you go for surgery, stress free. Nothing will happen to you, that I assure you.

Hello Swati,
Generally, most of the companies will have the notice period of 1 month. As it was mentioned in the appointment letter that 3 months notice period and 3 months salary, it will be applicable for all employees including trainees. But you have the genuine reason to resign so convince them by explaining your problem or else tell them that "I will be joining back with you after I get recovered".

Can you mention the line of sepration from service . i think your employer has mention the clauses for the same. And read the Standing order of your organization (if your organization have). can you post the wording of your appointment/offer letter.
if your organization is well known definetly they have clause for the same. after seen the appointment letter we can say anything.

Swati like many other members have mentioned an employee is bound to follow company policies once he join the organization & hence even if there is variation between the clause in appointment letter & company policy OR there is nothing mentioned in the appt. letter AT ALL, you are bound to follow company policy.
But, because you have a genuine reason for not serving the notice period company can consider on such grounds. Do not worry. Now, if they insist you to pay the notice amount, you can tell them that you'll join the duties once you get well & complete the notice period. Alternatively if you do not want to join that company for any reason you should stop thinking about that & wait for the company to take next step. Do what your MORAL says you to.

The same issue i faced in th e police station itself for my cousin, though i am HR i have experienced thse kind of things as practically.
My cousin had signed the bond with one company for 3 yrs, it was electrical company thet they put him across india for multiple projects even thoug he is fresh engineering graduate, he has been paased across the states for 2 years, then one day he got suddenly return to home from their north india project site. then he has been spent his day in home without any job more than 5 months, bcos of mental stress, it became increased up to violent manner. bcos he surrendered his certificates in his previous employer. so we could understand his problem due to his certificate surrender he got stressed, he got treatment too from psychologist. On my suggestion you can go to your organization and to meet your Hr and your Boss. Already you told that you has joined as Trainee, there are several legal points un favour to you which I could not mention here. Negotiate and finish nice.
This is your starting career.
