most of people here are talking about time n money wasted by employer on employee... Employee has done nothing to get a job??? specially gov job where there are so much competition... wen i accept job i also dint think that i wil ever think to leave this job...
but i can compromise with my personal life specially when i can have better option...
bank work is so easy... u just need to see it once and u can perform even better then manager if you are little bit speedy and accurate....
i have not passed through any training...
i have not wasted any time of my seniors in teaching me anything infact i work more than my very senior officers...
anyways my question is as it is HOW TO BREACH SERVICE BOND WITHOUT PAYING BIG AMOUNT OF MONEY AS 1.5 LAC...

Efforts of each and every candidate is appreciated by every recruiter.

We never said you didn't put in your efforts to get this job. Be it a banking industry or any other industry, be it a govt job or a private sector job, the rat race is always there. Nobody ignores that and nobody says you had a cake walk to the job. However it would be appreciated if you could look at both the sides.

Another thing, as you said... Nobody forced you to accept this job even after going through the procedures. None of the interviewer will tell you that i've spend 1 day analyzing your CV and then 4 hours to design a test for you and x hours to evaluate it and another y hours to interview you, so you're bound to accept this job if or not you like it. The time and efforts you've given to achieve this job, they've spent equal efforts to give you that opportunity. How do you think the test are designed? How do you think they're evaluated? Who took your interview? Who is handling the information and communicating to you or for that matter anyone who appreared the test. Have they not compromised on their time and efforts to this additional job of accomodating you all for this process?

I believe you are a graduate and yet talking like a child is something that is not appreciated. See let me explain you this way, you're taking a bus, asking the conductor to give you a ticket for last stop which he gives and then you are about to pay and realize that you've boarded a wrong bus. And now cursing the bus and the conductor. You should have asked before you boarded. Likewise you should have enquired about banking industry and its work culture before you joined in. You're in a soup, admit it coz of your own fault, and not coz of the bank's fault. so why should bank suffer for your mistake?

This is the simplest way this could be explained.

With Reference To payment of amount as part of agreement one has to see the reasons / circumstances under which the amount need to be paid. If the person concerned does not earn any skill / knowledge out of training undergone in the course of employment then need to pay, otherwise one can take decision not to pay and face the issue as per law if arises.

That is true sir, but the bond is for the period of 3 years, it is very obvious that they would say training is distributed as: X, Y, Z...
Also as i mentioned earlier, there are on-the-job training, wherein you are allowed to do the job with the risk taken that you might be mistaken. It does involve that cost.
The training these days are not just traditional ways classroom or even online trainings, there are so many ways to train.

Another thing, who is to decide if the training is rendered and served the purpose. There has to be then a third party problem solver who is unbaised and neutral to both employee and employer as the employer may argue she possessed so and so skills coz of so and so program/event, while employee may clean chitly reject the same.

A bond never states that if you do not enhance your skills from traiing given, we won't take the bond charge. It just states that if employee terminates employment, he/she is liable to pay so and so amt.

in a govt bond.. first you pay that amount after that approach court and get your money back.. but first you have to pay

Hello,

All the discussion so far is good as it displays different view points.

To me the issue is SIMPLE.

Forget the LAW aspect, forget also if the bank has offered real training or not!

Just consider that in life while you have to be legally right, even if there is no law involved, you have to be morally right!!

Consider:

1) The Bank offered to employ you IF you agreed to sign a bond (with all conditionalities).

2) You accepted and because you were found suitable for the job, you were appointed!

Now you have found some issues that suggest to you to move away. These can be real ones too but the question is, in civil society can I evade, avoid, ignore my own word?

If you break the bond, the bank may or may not proceed against you legally or otherwise and that is NOT the issue. Even if you yet BREAK the bond, do so, so long as you are willing to bear the associated cost! In life all our actions/omissions carry a "cost"-direct or indirect, immediate or at an unknown time in future, in one form or the other. So long as you are prepared to accept this reality, by all means go ahead and break the bond!

In any case, as an individual you have an inherent right to take decisions! Why seek guidance from others when you are willing to bear the associated cost? Or, is it that you psychologically NEED a kind of "approval" from others for whatever you do?

I am sorry if I am found to be harsh but in my personal opinion (which you need not accept!) your dilemma is a moral dilemma ahead of a legal one. Rest is immaterial

Take your decision and at least inform of your courage either way!

Hi All,
Even if it is a government company.What if the organisation has not provided any training and directly assign him in a task.
Because many of the government PSU's they mention, after 1 year of successful training you will be made permanent.In real scenario trainings will be provided by very few PSU's during 1st year.So what can be the liquidated damages done by the employee as the company didn't provide any training as mentioned in the offer letter.

Whatever you are doing in the first year of service, it will be under the supervision of a well experienced senior person. It is considered as On The Job Training. Please do not expect that you will be given only class room lecture training. If you expect such training then you cannot perform in your organisation.

Believe in yourself, if you are sure you don't want to do this, no point wasting three years of your life at its prime.
As per not paying 1.5 L goes, talk to your boss about if he can help you get that waived, talk to a lawyer about whether the company can force you to pay it and then take a call.
Of course, there are examples of people who try and fail but if you keep on trying enough, you would succeed sooner or later, so don't be afraid of that.
