i am from volvo bus service company at kolkata. This is our family business. I am the brother of the director. i had seen 5 dvd was going out for the repair but in gate pass our staff was showing 4 dvd. I had given a mail to store incharge and c.c -to Our General Manager & Director(My Brother). But my G.M HAD Suspended me for a day.......what can i do for it. How can i fight for this issue. Please help.

It will be better if you talk to your brother personally and tell all the issue that all these things going on and this should be taken care from next time.

Dear Kishan
Please reply to the following question
1. Once you have seen 5 DVDs on the gate why you have allowed to go out.
2. Have you asked the Security while sending out and did you check the Outward Repairable register entry for the correctness, whether it is 4 or 5 in gate pass as well as in register.
3. Immediately have you enquired and discussed the matter with the Stores in charge.
4. Why you have not discussed the issue with your brother who is a director of the company.
5. If discussed what was his reply.
Please reply to the above question. Surely our members will give the suitable advise to you.

Dear Sir ;

Replying to the following questions -

1. Car Driver had informed me on privacy that Sirji 5 DVDS going in my car with Mr. Biswas Babu (Store in-charge) for the repair but they had given Gate pass for the 4 DVDS only.

2. As per Security; they had checked the car properly when it was going to Market there was only 4 DVDS (but as per my driver 1 DVD they had putted under the register).

3. I discussed the matter with the store in-charge he replied we had taken this only for the sample (not for the repair). I replied - why we are not entering sample quantity on gate pass register. He simple replied - No.

4. I discussed with my brother - 'Insubordination' due to this G.M. had suspended me. Brother told - TUMKO MUJHE MAIL MEIN C.C. NEHI RAKHNA CHAHIYE THA, insubordination ka matlab yehi hota hey but i accepted my suspension and I replied to G.M. that I will be on suspension mode as per your instrct. but i will attend the office on that day and my brother replied thats good kishan and i will handle G.M. on this issue after durga puja.

And 1 More thing i have to ask..........
As per Management instruction, we had done the 5 days duty during durga puja (in Holiday). Can we take other charges for this duty and how much amount we will take. My Salary is 6000/-

Please do not simply believe the word of the Car Driver or anyone. If you see then you can take up the issue with management. Otherwise it will be affecting your career in the company.
Whenever you face such issue immediately you must discuss with your immediate boss and the concerned persons instead of sending mails.
Without conducting any inquiry the GM cannot suspend you. You can ask him the reason for suspension, but it must be asked through proper channel.

Dear Kishan
In case if you work on any holiday being declared by the organisation, then you are eligible for Compensatory Off and present for the day you worked. If C Off is not given then you will get one day payment (as this is the Paid Holiday) and whatever period you worked you will get double OT for the period.
Here if you work totally 30 hours on all the five days then you will get 5 days present and 30 hours double Over Time Charges.
Hope you have understood the concept.

Sir, Please make me understand about double OT . I had worked 5 days in Durga Puja that is totally declared as leave in our organisation. In that case how we calculate the OT. Regards Kishan

What is your daily rate of payment. = Rs.6000/26 = Rs.231 per day is your one day payment. If you divide it by 8 hours then you will give 1 hour payment. If you multiply with 2 then it is Double the rate of OverTime Payment. i.e., you will get Rs.57.70/- per hour for the period of your work

You can approach the Labour Commissioner Office of your district and while going please keep all the records with you to produce to him. You must have the company I Card, your pay slip and if you have your attendance card with in time and out time record with you, so that you can prove about your work. If you are less paid you make the note of the same and do complain to your District Labour Commissioner. He is the right person to approach.
