We are a Private Ltd company in Thane registered under Shop & Establishment Act having employee strength of 300+ on payroll. please guide me about the various returns we need to file under Labour laws. we are currently filing appropriate returns for PF, ESIC & PT. what other returns are applicable. we are into Marine Geotech survey, engineering and construction business.

pl go through the Maharashtra rules under Gratuity Act,Payment of wages Act (if applied to Shop & Commercial establishment in your state),Bonus Act,CL(R&A )Act,Shop &Commercial est; Act,Interstate Migrant Workers Act,National&Festival Holidays Act,Apprentices Act,Child labors Act (If applicable).Maternity Benefit act,Standing Orders Act (if applicable)Minimum Wages Act,EC act.

In addition to Mr. Varghese Mathew, you have to submit the Half yearly return as per Contract Labour Act (Form XXIV), Annual Return as per Minimum Wages Act (Form III), and further you have to submit the Annual return as per Shops and Commercial Establishment Act.

If you go through the Monthly News Letter published by the Regional Councils of the Inst. of Company Secretaries of India,it will be very helpful for you.Every month ,they published a ready reckoner regarding compliance of various statutes inter-alias indicating nature of returns to be filed ,due date of filing etc.Apart from that, you can follow the advices given by the experts above.
I was told that Annual Return under Min wages act is not applicable in maharashtra any more. Are you still required to file it ?

At present, in my monthly CTC Ex-gratia/bonus component is included which is retained by the company and the accumulated amount is paid once in a year during Diwali. if someone leaves the company can the amount of ex-gratia be lapsed or it should be paid along with F&F?
As per my understanding, if the Ex-gratia component is included in Monthly CTC it means that it is considered to be a committed amount to the employee and must be paid irrespective of loss/profit of the company and the period of service tenure of the employee. e.g. XYZ's monthly CTC is 50000/- which includes 1500/- Ex-gratia which is being retained by the company on monthly basis and the accumulated amount (from April to March) being refunded every Diwali . if XYZ serves the company for 3 years and leaves in the month of May, can the amount retained from April last year to May current year towards Ex-gratia be forfeited giving an excuse that the employee is not available till diwali? please advise!!
