Hi,
Could anyone tell me how many leaves we can implement according to Tamil Nadu labor laws? We take care of ground handling for one airline. Our staff includes customer service agents, loaders, cleaners, helpers, and drivers. We want to implement a leave policy for them and also want to know whether we should allow them or if they are eligible to get leaves during the probation period (6 months).
Thanks,
Neha

As per the law, there are mandatory 4 days of leave which are:
1. Jan 26
2. May 1
3. Aug 15
4. Oct 2
Apart from these, the company may choose any of the listed holidays as per their convenience from the appendix on the tn.labour website with a minimum of 9 holidays (4 + 5).
Employees in organizations are eligible for a casual leave of 1 day per month from the date of joining.
Once an employee completes 240 days of work, he/she is eligible for earned leave (in the succeeding year) of 1 day for every 20 days of the previous year's work.
Hope you do get what you have asked for.

From your post, I infer that your establishment is under the TN Shops & Establishments Act, 1947. There is no distinction of persons employed under the Act with reference to their status of employment such as permanent, probationer, temporary, etc. As such, all the provisions under the Act relating to conditions of service uniformly apply to one and all, except the exempted categories.
Leave Provisions Under TNSE Act
The TNSE Act prescribes three kinds of leave, namely Casual Leave, Sick Leave, and Privilege Leave, each at 12 per annum. Besides, the employees shall also be allowed 4 National Holidays and 5 Festival Holidays every year under the TN Industrial Establishments (National and Festival Holidays) Act, 1958.
You can understand the preliminaries of procedural compliance like approval and calculation, carry forward of the unavailed portion of certain leave, registers, and forms to be maintained, etc., by going through both the Acts.

Hi team, I work in a tiles manufacturing and selling company with the factory located in Tamil Nadu. We have a registered office and a branch office in Tamil Nadu where we only handle sales and marketing. Therefore, our company falls under the trading segment. Could you please advise me on the leave policy for trading companies in Chennai, Tamil Nadu? I am interested in knowing the number of days employees are eligible for Sick Leave (SL), Casual Leave (CL), and Earned Leave (EL). I have received information that trading companies do not provide leaves except on Sundays. Is this information accurate? I am looking forward to your reply.
