Hi all as per gratuity law in india is governed by the payment of gratuity act 1972. gratuity is a lump sum payment made to an employee on a resignation b termination on account of death or disablement due to accident or disease c retirement d death. just wanted to know what is the procedure to be followed under the situation of dismissal or disciplinary issues. is the gratuity forfieted case by case basis or for all dismissal and disciplinary issues?? regards ina
Witholding of gratuity after retirement
Hello seniors i have a question related to withelding of gratuity after retirement. is there any laws under which the gratuity can be withheld after retirement if so what are the conditions under the law. my father retired as a bank manager before an year and his gratuity has been withheld. what legal steps can be taken now. posting it again as i am unable to find the previous thread
Gratuity
Dear seniors our company is completed six years and still we have not registered in gratuity scheme. recently our two employees left the job at the time of full and final settlement i have paid the gratuity amount as per the act and management was also agree to pay that amount to them. now my question is that our company is still not registered in gratuity because of some management issue but we are paying the gratuity amount to the employee at the time of leaving the organization. in that case which documents i have to maintain for the employees gratuity benefits or which form i have to filled up from them. please help. thanks & regards vaishali
5 years continuous service - gratuity
In furtherance to clarification on gratuity calculation i would like to know on the issue relating minimum qualifying service which is 5 years. there are divergent views on the issue. according to one school of thought if the employee has completed 4 years of services and worked 240 days in the 5th year he will become eligible for gratuity. another school of thought says that one needs to complete 5 years of continuous service and then only he will be eligible for gratuity. the rounding off concept will apply only after completion of 5 years of continuous service. can any body guide me on the issue. thanks & regards prakash k

Dear all members if somebody can guide me regarding my gratuity related issue? i worked for a limited company for 9.5 years. in the appointment letter they have mentioned that you are eligible for the all co.'s benefits but not mentioned like pf & gratuity words. now when after resigning from the company i requested for the gratuity they say that they do not pay any. what are the rules? as per my knoledge even a shopkeeper has to pay the gratuity to the sales man if he has worked more than 5yrs. but i was working in a limited company where more that 500 peoples are employeed. can i file suit against the company? where i have to file the suit to get my gratuity? please help>>>>
Gratuity payment if company says they have not applied for gratuity
I worked in a pvt ltd company for 5 years and 10 months and when i applied to gratuity they replied that they have not applied for the gratuity and they did not deduct any amount from the salary related to gratuity. so they are not bound to pay the gratuity. is it right?
