Dear Seniors.
Need Assistance Regarding the over time wage calculation for drivers. here we have a strategy that charging penalty for the late comers. Working time from 9 am to 6 pm. 1 pm to 2 pm will be the lunch break. if any one is coming by late that means after 9.10 am. considered as late.
My question is.. On what basis should i calculate the OT? in case of an employee coming by 9.45 am and leaving at 7.40 pm.

First of all, you should try to make a rule that everybody have to complete their work in stipulated time. if there is any major issue then OT is calculated as 150% rate of their payment.

An employee/ workman is entitled to O.T if he works for more than 48 hours per week. keep aside the punctuality issue for some time.Irrespective of the time at which he repots for duty or leaves his workplace, find out as to how many hours of work he is putting in at the workplace in toto per week. If it exceeds 48 hours per week, he is entitled to O.T.

An employee is entitled for OT if he/she works for more than 48 hours in a week and it has nothing to do with late coming or punctuality..
Late coming is treated as Indiscipline in your company is a matter related to your company only and it has nothing to do with Factories Act.. But suppose if your company is having any Late coming Rule like this (I don't know how much it is legally viable) ;
Late coming (upto 1 hour ) - fine of Rs. 10 or any
Late coming ( more than 1 hour upto 2 hours) - fine Rs. 20
..
.....
.......
like this then you may deduct the amount accordingly from his/her salary by keeping into mind the Provision laid down under the Payment of Wages Act and Minimum Wages Act.. But the calculation of Total OT amount Payable has to be done as per Rule under Factories Act..

when people are late penalty is charged but when people work overtime no benefit is given to them, i was coming earlier to office but i was leaving late but still my salary was less than other employees
