Dear All,

I am working with a private organisation having operations in 15 states. Corporate office is located in Mumbai. Contract labours are engaged in all the sites. But the contractors does not have any PF/ESI registrations. So what will be the liability of the company regarding PF/ESI. How the amount can be deducted from the contractor. Since all the contractors are agree to deduct the PF/ESI liability amount from their bills. Then how the deduction can be done to comply with all necessary statutory requirements.

Need advise how we calculate the wages for PF/ESI

For example:

A person worked for 2 days in a month and his daily wages is Rs.600/-. Then how will be the calculation of PF/ESI liability from the contractors bill??

Another case is

A person worked for 10 days in a month and his daily wages is Rs.240/-. Then how will be the calculation of PF/ESI liability from the contractors bill??

What will be the criteria for deduction of PF/ESI for daily wage workers.

How can manage this type of contract labour issues??

How can maintain proper compliance of all statutory requirements in this type of issues?

At the same time it would had been a better approach for your organization as the principal employer in case you had engaged a contractor who had the necessary statutory registrations.
Now as a short term approach to the solution,ask the contractors to furnish you the master roll and wage register on monthly basis upon which your organization needs to make the contribution to PF,ESIC on the respective codes assigned to your organization.You may simply refer to the respective portals for this process.
