What is required to be done if an employee is terminated? this is a manufacturing company of medical instruments ophthalmic devices in new delhi how many days of notice to be given as per law? is any amount to be paid of for further days extra then notice period. as employee here is asking for months of amount to be given to him. is there any law. please suggest it is urgent.

A employee is terminated for his misconduct of assaulting his co worker outside the premises the assault incident happened due to the quarrel between them during working hours. show cause notice issued he has been suspended subsistence allowance paid and he is terminated by conducting domestic enquiry he has not attended the proceedings even multiple oppurtunites provided it decided is by the officer on exparty. he has been terminated from service. the gratuity amount paid to him by cheque and he encashed the cheque under protect. now he approached the labour cout under section 2aa of the id act. is it valid o n part of him? what are all the possibilities to counter the employee?

Absconding employee with company collections
Dear all please advice if the company can file a police complaint against an employee who has absconded with the company money. here are certain other facts to the matter: 1the absconding employee s salary for preceding month has not been paid. 2 the absconding employee s has joined a competitor company. 3the company has sent him a formal show cause notice explaining why he should not be terminated for dereliction of duty uninformed absence and non deposit of company collection money. 4no response has been received till date and it has been almost 7 working days since the dispatch of the registered ad letter and hence as of now the employee has not yet been terminated. if the amount due can be recovered from his salary then are we still on the right to file a police complaint of theft and cheating. plz guide. rgds anuradha
Notice pay
Hi all if somebody s services are being terminated by the company and as per the terms and conditions of the appointment letter there is notice period of three months. in the lieu of this notice pay company should pay three months salary to the employee. now i would like to know is it possible that company ask to the employee to sit at the home and his notice pay will be paid to him after three monts only? in my opinion it should be paid to the employee on the expiry of the second working day from the day on which his services was terminated or on monthly basis. pl comments
Termination
Hi need some update on termination rule and law. recently one of my friend have been terminated by his company for refusing to take transfer to a different city. the hr has forwarded a letter which clearly mentions that he has been terminated with immediate effect and will be paid salary upto last month plus one month extra pay out. he is having the company id and few other assets with him and willing to handover to company and get his fnf settled. the company hr has told it will take 45days to settle his fnf after depositing all assets as per company s protocol. he has asked for the confirmation mail asking for the total amount he will be paid and the date on which the fnf settlement will be handed over to him but they refuse to provide any information and every time giving a different excuse for not able to provide information. as far as we know in case of a termination by the company the company needs to process and hand over fnf within 24hours but this company is not willing to do so. in such a scenario what is the best he can do gets his dues cleared asap.
