a security guard working 12 hr in a day and 7 days in week.is it possible to suit on this base against admin. officer? and it may be criminal case against a admin officer?is it also possible to high court or only a labor court?

Dear Kanchan,
But then this is what all the security companies do. You have written about 12 hours. But then practically they work for 24 hours many times. After completing shift in one company, he goes to nearby client and starts with next shift.
Are you taking up cause of only particular guard or all security guards?
Secondly, in your writ petition, you cannot make Admin officer as respondent. Your writ petition should be against "occupier" of the company. Admin officer might have signed agreement with security agency but then it is on behalf of occupier so petition also should be against occupier.
I appreciate your courage to take up cause of security guards. You are different. You are fighting against injustice. God bless you.

You should first approach the concern nearest assistant labour officer and you can complaint against you company (only company) and the assistant labour officer is duty bound to take action and he has a right to file a criminal case before the first class judicial magistrate. If he is not taking action you can directly approach the criminal court
