Dear all,
pls let me know that if sunday is weekly off and not worked by contract labour then is this payable or not?
also if they worked on this weekly off as on sunday (but only for half time or 4 hours duty) then what will be paid?
in both condition daily minimum wages rate for particular category is 180 Rs.

a) Yes, Sunday is weekly off for them or we have to provide one weekly off in any day during the week, hence no need to pay for weekly off. As per the Contract Labour (Regulation and abolition) act “to arrive at daily wages the monthly wages shall be divided by 26, which are inclusive of holiday wages, as per the Contract Labour (Regulation and abolition) act.”
2)Also if they worked on this weekly off as on sunday (but only for half time or 4 hours duty) then what will be paid?
a)If they worked on weekly off we have to pay Overtime wages.
3)In both condition daily minimum wages rate for particular category is 180 Rs.
a) Min wages per day / 8 Hrs X 4 Hrs X Twice = 180 for 4 Hrs

now want to know that if the notification of central govt. is not showing monthly wages but daily based wages shown
in this notification with describing categories and particular daily wages rate for each then will it be treated as inclusive
of holiday wages or not ?
And what wages will be paid if on the general day anyone does overtime ?will he get double OT or single ?
and what is the limit for overtime as in one day working hours will be 12 in maximum, is this correct or not?

This is ongoing factory and we have awarded civil work for their expansion.the principal employer is nav ratan company of central govt.
I understand it is registered under Factories Act. Rules pertaining to Factories Act will be applicable

1. Daily minimum rates of wages is Rs 180/ and this will be paid for all worked days.

2. Weekly off days need not be paid.

3. If you ask these employees to come on a Sunday, then you must give weekly off one day either in advance (prior Thursday or friday or saturday) or within the next three days(Monday,Tuesday or wednesday) If you follow this, you need not pay wages for Sunday.

4. If you do not give weekly off, but ask these employees to come and work on Sunday for 4 hours, it is not legally correct. However, you need to pay double the wages In other words, for making them to work on Sunday for 4 hours, you need to pay Rs 180/

5. This does not actually solve the issue as you will be questioned as why you have not given them weekly off.

What is the nature of work these people are performing? Are they involved in civil construction?Or are they involved in maintenance and production jobs? There are exemptions for certain types of work on specific rules. Thi needs to be examined.

But from the facts you have provided, I would advise you to consider four hours work as OT and pay them double the wages.
