My date of joining was 19 oct\' 2007 & date of leaving the company is 17 july 2012....Also i had not availed my earned leaves i.e total 19 days....so now please confirm...if i am eligible for Gratuity money or Not .

The earned leave no way conected with Gratuity. The latest amendment says a person is eligible for gratuity if he worked 4 years and 240 days in the 5th year. Please check your days worked during your 5th year.

Dear Mr. Rana, if you have not availed earned leave so please go throw your company policy, and a person is eligible for gratuity should be completed 5yeas. thanx, Vandana

Refer to your query on the above subject,there is no connection between ELS & Gratuity. Please refer Sec 4 under payment of Gratuity Act -1972 Rules for eligibility criteria.It describes an employee who has completed/rendered 05 years continuous service in an organisation at the time of resignation, retirement, reaching the age of superannuation or any other contract between employee or employer, then only he eligible for Gratuity.But in the case of Death or Permanent Disablement the question of 5 Years continuous does not arise. Continuous service means an employee who has worked more than 240 working days in a calendar year exclusive of Leaves, Weekly Off\'s, Holidays etc.,only actual working days to be taken in to consideration for calculation of working days.if the employee met with injury for Temporary disablement or a female employee goes on maternity leave the days should be countable for calculation of working days.In the case of Strike or Lockout the part o

Dear Mr. Rana,
Please note that EL is not connected with gratuity.
You may only eligible for gratuity, if u have completed 5 years or 4 years 240 days in the same organization.
Regarding your balance earned leave, you may apply to en-cash the the same as per company's policy. If you have already resigned, the same will be cleared at the time of final settlement.

Thanks for your replies, Still i am confused that i am eligible for Gratuity or Not. Because i joined the company in 19 oct 2007 & left the same organization on 17th july 2012.
In last four years, i had worked permanently in the same organization. AND
No more leaves i have taken in 5th Year except week offs & official holidays, so if i count my 5th year days from the date i.e 19th oct 2011 to till 17th 2012 then the total days comes to 272 days.....But if i subtract the week offs & holidays then total days comes to less than 240 days...
Now please confirm if i am eligible for Gratuity money....
