I have changed my job last month. Before leaving my previous employer, I had submitted my resignation to my HR & AVP through email and received confirmation. However, I have not yet received my clearance, including last month's salary, incentives for three months, and service charge for three months. They are currently not responding to my calls or emails. Please advise on the best course of action I can take to secure my clearance. (It's in the hotel industry in Bangalore).

There are no provisions for full and final settlement provided by any Act/Legislation when an employee resigns. Normally, the company establishes its own policy in this regard, which typically involves a 45-day period as it takes time to gather attendance feedback from line managers.

If you wish to settle with your previous employer, you can visit them, discuss the matter, and inquire if they are willing to provide a settlement. If they agree, that's great; if not, you can send them a letter outlining all the facts and circumstances. If the issue persists, you may seek assistance from the Labor department.
