As per appointment letter stated in company's I am working in, 2 months notice period.
As no separate provision has made for notice pay period in probation means evenif employee put resignation during notice period say on 4 or 5th months, notice period is applicable so deduction takes place when serves short to notice period like 1 months so rest 1 month deduction permissable.
I want to know with labour act,is deduction for 1months on basic+ d.a or gross when employee is in probation period?
Though I believe that notice days to be deducted on basic in F&F,
Labor Law experts pls guide.

As far as I know, there is no labour Act in India at present which covers notice period or deduction/payment thereof.
It is an arrangement jointly agreed to by the Employer and Employee to allow some time for both to accommodate the gap.
As a penal measure payment/deduction in lieu of notice period are one part of the arrangement. This is guided by the terms of appointment or Standing Order as the case may be. Some concession are allowed to the probationers-the notice period being lower than the confirmed employees.
So far as the amount is concerned it is usually the Gross salary.
