How to sack a sales manager during probation
I hired a sales manager from 1st september in my company. his offer letter mentioned the following: ou shall be on probation period of six months from the date of joining. depending upon your performance during probation period the management may reduce/extend the probation period if required in writing. during the probation period the company may for any reason whatsoever terminate the employment without serving any written notice. on completion of the probation period your services may be confirmed by the company by issuing the confirmation letter. however till the management issues you confirmation letter confirming your services you shall be deemed to be on probation.in this regard the decision of the management shall be final and binding upon you. during the probation period in case you wish to leave the service one month prior notice or one month pay in lieu of notice is mandatory his performance is nil in last two months wherein during interview he had promised a minimum sale of rs 20 lakhs every month.
Extension of probation period - can that manager terminate her in this extended probation period if she gets pregnant?
Hell all my cousin is working in it department of an reputed firm from last 1.5 years and in this time period she was working as trainee engineer for first year and after that for 6 months was on the probation period. the thing is that her manager got changed when her probation period started after one year in the company and now when the probation period is ended manager stated to her that he will give extension for 2 months with no reason. my cousin is shocked because according to her she has given her 100 best performance in this last one and half year of her service by completing all tasks in give time period even when the time her miscarriage happened before 7 months ago at that time also she had not taken any leaves and managed all tasks assigned to her by working from home. now she is expecting pregnancy again and in this time period she has to suffer from this critical situation. from the wordings of her manager she clearly understood that manager is not in the mood to make her permanent employee in the company. she is unable to understand if she got pregnant in this extended probation period then can manager terminate her or what will happen. just wanted to know can that manager terminate her in this extended probation period if she gets pregnant and if she is not pregnant then also can he terminate her? please suggest here.

Ego clashes between employees
Dear seniors i am working in a mid sized it company as hr manager. we have promoted a sales person recently as sales manager. we have a sales team of 4 members. all of them have to report to the new sales manager. now the problem started when one of the sales executive came up after 1 month saying that he does not want to report to the new manager .we came to know from sources that the sales executive is not a team player and he finds the reporting structure rigid as new sales manager has his own style of working he is a person who like to work as per processes and rules and regulatgions of the company. sales manager is little strict and harsh with his team mates but people take it negatively that after he became manager he has become arogant. both the people are performers so we do not want any one to leave but if we take decision in favour of one other s ego will be hurt and anyone of them may resign. i would appreciate if anyone can help me in resolving this issue. regards divya
