If the comPany has terminated your emPloyment following the rules and also filed a case of cheating against you it is unlikely they will give you a subs instance allowance
The company would take such a step as above of filing a criminal case it is a serious matter and the company intends to get you punished.

You didn't mention whether you R suspended or terminated, but only said they have not relieved you. Which means you R still attending to duty ? If this is so you got every right to claim your salary. Still if they R not paying you, claim it thro' an ALC OR Advocate. Since you have mentioned you R A3 it appears you R not the main accused. Your Advocate will help you how to get your salary without break during the pendancy of the case as still you R not terminated or suspended.
Is there any Domestic Inquiry instituted & pending ?

They not suspended or terminated me nor they relived me nor I am going to office but they have taken my resignation latter & they filed the case now past 7 months I don't have Job , no income, I have attended approx 40 interview getting negatives response. From x company due this reference I not finding the job , now my family is on mid of crisis I don't have any thing say, more over I have to pay lawyer fee, daily life is also come still , I am looking by any chance I can get my settlement or basic salary or any allowance I can clime from the x company pls suggest is there any law which support

Since you have given the resignation letter hardly you will have better chance of your salary etc. Notwithstanding, your PF & gratuity is secure. But still they have not relieved you & not communicated the fate of your resignation whether accepted or not. Did they communicated to you not to attend duty ? If it is oral you should insist for an written communication till such time you will be considered to be on roll. You can fight it out thro' your advocate. You may also try thro' your ALC.

Gratuity can be set off against damage claims. Pf can also be attached in case of fraud. What is the ground for the case. What did u do ?
