Dear seniors,
A worker worked under any ltd. establishment and recruits for defence service and got joining offer letter. He had advised to join immediately but he need time for the month end i.e. 30.04.2011 and commit to join on 1st May 2011. Current establishment also release him to join his new job 25.04.2011. in the meanwhile unfortunately on 28.04.2011 he met with an accident in cos premises and lost his left leg.
Now, present employer state that he had release from their end as well as no one had bound him to continue, therefore it is not his responsibility.
Kindly suggest what will do?

your query is not clear. Did he meet an accident with the new employer’s premises or old employer premises? Pon
as long as he was in the rolls of old employer, the old employer shall be liable for the compensation payable to the dependents of the deceased when the accident occured in their premises. pon

I have query to be asked..
if an employee meets an Accident on the way of coming to the Factory to work or leaving from the factory after working.
sholud the employer send Accident Report?
1. To ESI ?
2. To the IF Office ?
regarding his accident???..

In maharashtra all said and done the responsibility lies of the principle employer.
The occupier of the company is responsible for safety of contractors, visitors and other interested parties.
I do not know rules in CG.
However these should be the same.
This reminds be to let you know the following fact.
" When Hotel Taj was attached by terrorist, Ratan Tata even gave the benefits of sorrounding hockers who were dependent of Taj customers. This fully depends on the social responsibility. However Managements can manage to prove the other person to be guilty.
