The judgment referred i.e WC Case Francis D Costa. Doc is against to the injured person, which is against to the opinion expressed bu Mr. Madhu T.K. I request Mr. Harikrishnan to check it out and furnish a judgment of Supreme court in favour to the Injured workman.... Kesava Panda.

It is once again reiterated that Mr. Madhu T.K. reaffirmed notional extention in favour of the injured person but referred judgment of Madras High Court different from his saying "Tamil Nadu State Road Corporation Ltd Vs Smt. Sivakumari & Ors [LLN(1) 2010 (P) 414 (Madras HC)]" It is requested to refer a suitable judgment in favour of the injured person on notional extension.

Dear Sir,
one of my brother met accident and he died while going to company around 5 AM. but his shift start at 6AM. he is the only son for his family and he is the bred and batter for his family. his parents are asked company to give some compensation, but company rejected it and saying he met the accident out of our company so we will not able to pay anything.. like that, is this will comes under ECA.? and his parents can able to get the compensation from the company since no one is there to take care of them,?
please suggest what they can do it.

Under construction workers, if the vehicle met with an accident while going to site/coming back from site - weather the employees or the third person comes under WC policy?.
and is there any time defined for the applicability?. eg. my contractor site vehicle left from office and later met with accident after 2 hrs, weather it will come under WC (the vehicle was used for personal usage at the time of accident)

If the vehicle was used for personal use at the time of accident, how can Workman Compensation be applicable. Let them claim under MACT
